1. Acceptance of Terms

By downloading, installing, or using ivey ("the App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App. These Terms apply to all users of ivey worldwide.

2. About ivey

ivey is a live poker session recording and analysis application developed by ARTZY. The App allows users to log poker sessions, tag behavioral patterns, and receive AI-generated analysis. ivey is designed for personal, non-commercial use.

3. Eligibility

You must be at least 17 years of age to use ivey. By using the App, you confirm that you meet this age requirement. ivey does not knowingly permit users under 17 to use the App.

4. License to Use

ARTZY grants you a limited, non-exclusive, non-transferable, revocable license to use ivey on your personal Apple device solely for your own personal, non-commercial purposes, subject to these Terms and Apple's App Store Terms of Service.

5. Subscriptions & In-App Purchases

ivey offers optional paid subscriptions and in-app purchases to unlock premium features.

• All purchases are processed by Apple through the App Store and are subject to Apple's payment terms and refund policies.
• Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current period.
• You can manage and cancel subscriptions through your Apple ID account settings.
• ARTZY does not process payments directly and does not store your payment information.
• Prices are subject to change. Changes will be communicated in advance through the App or App Store listing.

6. User-Generated Content

All session data, notes, and hand records you create in ivey are stored locally on your device. You retain full ownership of your content. ARTZY has no access to your session data.

When you use AI-powered features, relevant content (such as session text or hand descriptions) is transmitted to third-party AI providers for processing. By using these features, you consent to this processing. You are responsible for the accuracy and appropriateness of the information you input.

7. Prohibited Uses

You agree not to:

• Reverse engineer, decompile, or disassemble any part of the App
• Distribute, sublicense, or resell the App or any part of it
• Use the App for any unlawful purpose or in violation of any applicable laws
• Attempt to gain unauthorized access to any systems connected to the App
• Use the App to infringe on the intellectual property rights of any third party

8. Intellectual Property

The ivey App, including its name, design, graphics, icons, and code, is the property of ARTZY and is protected by applicable intellectual property laws. Nothing in these Terms transfers any ownership rights to you.

9. Third-Party Services

ivey integrates third-party services including AI providers and analytics tools. Your use of features powered by these services is also subject to the respective third-party's terms and privacy policies. ARTZY is not responsible for the practices of third-party providers.

10. Disclaimer of Warranties

ivey is provided "as is" and "as available" without warranties of any kind, express or implied. ARTZY does not warrant that the App will be uninterrupted, error-free, or free of harmful components. Poker analysis and AI-generated insights are for informational purposes only and do not constitute professional advice of any kind.

11. Limitation of Liability

To the fullest extent permitted by law, ARTZY shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of ivey, including but not limited to loss of data, revenue, or profits, even if ARTZY has been advised of the possibility of such damages.

12. Changes to These Terms

ARTZY reserves the right to update these Terms at any time. Continued use of the App after changes are posted constitutes acceptance of the updated Terms. We will notify users of material changes through the App or App Store update notes.

13. Governing Law

These Terms are governed by the laws of Taiwan (R.O.C.), without regard to its conflict of law provisions.

2. 關於 ivey

ivey 是由 ARTZY 開發的現場德州撲克牌局記錄與分析應用程式。本應用程式可讓使用者記錄撲克牌局、標記行為模式，並獲得 AI 生成的分析報告。ivey 設計供個人、非商業用途使用。

3. 使用資格

您必須年滿 17 歲才能使用 ivey。使用本應用程式即表示您確認符合此年齡要求。ivey 不允許 17 歲以下的使用者使用本應用程式。

4. 使用授權

ARTZY 授予您有限、非獨家、不可轉讓、可撤銷的授權，讓您在個人 Apple 裝置上，僅供個人、非商業目的使用 ivey，並須遵守本條款及 Apple App Store 服務條款。

5. 訂閱方案與應用程式內購

ivey 提供可選的付費訂閱方案與應用程式內購，以解鎖進階功能。

• 所有購買均透過 Apple App Store 處理，並受 Apple 付款條款與退款政策規範。
• 訂閱方案將自動續訂，除非您在當前訂閱期結束前至少 24 小時取消。
• 您可以透過 Apple ID 帳號設定管理及取消訂閱。
• ARTZY 不直接處理付款，亦不儲存您的付款資訊。
• 價格可能調整，相關變更將提前透過應用程式或 App Store 頁面通知。

6. 使用者產生的內容

您在 ivey 中建立的所有牌局資料、備註與手牌記錄均儲存於您的裝置本機。您保有對您內容的完整所有權。ARTZY 無法存取您的牌局資料。

當您使用 AI 驅動的功能時，相關內容（例如牌局文字或手牌描述）將傳送至第三方 AI 服務提供商進行處理。使用這些功能即表示您同意此項處理。您須對所輸入資訊的準確性及適當性負責。

7. 禁止行為

您同意不得：

• 對本應用程式的任何部分進行逆向工程、反編譯或拆解
• 散布、轉授權或轉售本應用程式或其任何部分
• 將本應用程式用於任何非法目的或違反適用法律
• 嘗試未經授權存取任何與本應用程式相連的系統
• 使用本應用程式侵害任何第三方的智慧財產權

8. 智慧財產權

ivey 應用程式（包括其名稱、設計、圖形、圖示及程式碼）為 ARTZY 的財產，並受適用智慧財產權法律保護。本條款不會將任何所有權轉讓予您。

9. 第三方服務

ivey 整合了第三方服務，包括 AI 服務提供商與數據分析工具。您對這些服務所驅動功能的使用，亦受各第三方條款及隱私權政策規範。ARTZY 對第三方服務提供商的行為不承擔責任。

10. 免責聲明

ivey 以「現狀」及「現況」提供，不附帶任何明示或暗示的保證。ARTZY 不保證本應用程式不會中斷、無錯誤或不含有害元件。撲克分析與 AI 生成的洞察報告僅供參考，不構成任何形式的專業建議。

11. 責任限制

在法律允許的最大範圍內，ARTZY 對因使用 ivey 而引起的任何間接、附帶、特殊、衍生或懲罰性損害不承擔責任，包括但不限於資料遺失、收入或利潤損失，即使 ARTZY 已被告知此類損害的可能性。

12. 條款修改

ARTZY 保留隨時更新本條款的權利。在變更發布後繼續使用本應用程式即表示您接受更新後的條款。我們將透過應用程式或 App Store 更新說明通知使用者重大變更。

13. 適用法律

本條款受中華民國（台灣）法律管轄，不考慮其法律衝突條款。
